{"id":19444,"date":"2020-03-27T11:33:04","date_gmt":"2020-03-27T10:33:04","guid":{"rendered":"https:\/\/www.berkinder.com\/renegociar-contractes-de-lloguer-i-covid-19\/"},"modified":"2020-03-27T11:33:04","modified_gmt":"2020-03-27T10:33:04","slug":"renegociar-contractes-de-lloguer-i-covid-19","status":"publish","type":"post","link":"https:\/\/www.berkinder.com\/ca\/renegociar-contractes-de-lloguer-i-covid-19\/","title":{"rendered":"Renegociar contractes de lloguer i COVID 19"},"content":{"rendered":"<p>Rebaixes, condonacions i morat\u00f2ries en els arrendaments (lloguers)<br \/>\nCom a conseq\u00fc\u00e8ncia de la situaci\u00f3 creada per l&#8217;aplicaci\u00f3 de l&#8217;Estat d&#8217;Alarma ens veurem obligats a renegociar molts dels preus dels arrendaments amb els llogaters que han estat obligats a suspendre la seva activitat o que l&#8217;han vist clarament minvada.<\/p>\n<p>Des del punt de vista fiscal, aquestes rebaixes, ajornaments en el pagament o condonacions totals o parcials i possiblement altres accions, poden comportar conting\u00e8ncies a l&#8217;efecte de l&#8217;IVA. i \u00e9s per aix\u00f2 que us volem recordar els seg\u00fcents conceptes:<br \/>\n\u2022 L&#8217;impagament de la renda comporta el MERITACI\u00d3 de l&#8217;IVA, i per tant, tot i no cobrar, l&#8217;arrendador est\u00e0 obligat a repercutir i ingressar l&#8217;IVA corresponent.<br \/>\n\u2022 En cas de pactar una rebaixa temporal o definitiva en els rebuts, \u00e9s important que aquesta estigui signada per ambdues parts i formi part de l&#8217;contracte com un annex. En aquest cas, a partir de el moment de la signatura, es podr\u00e0 aplicar en el rebut i en l&#8217;IVA corresponent.<br \/>\n\u2022 En cas de condonaci\u00f3 total d&#8217;una o diverses mensualitats, l&#8217;administraci\u00f3 podria considerar que es tracta o b\u00e9 d&#8217;un impagament o b\u00e9 d&#8217;una cessi\u00f3 gratu\u00efta.<\/p>\n<p>Ambdues situacions podrien comportar la meritaci\u00f3 d&#8217;IVA, ja que el servei s&#8217;ha prestat, la base est\u00e0 determinada i es exigible. En aquest cas tamb\u00e9 \u00e9s molt important tenir l&#8217;acord signat com un annex al contracte.
