{"id":19403,"date":"2022-03-31T11:51:03","date_gmt":"2022-03-31T11:51:03","guid":{"rendered":"https:\/\/www.berkinder.com\/18878-2\/"},"modified":"2024-07-09T14:14:05","modified_gmt":"2024-07-09T14:14:05","slug":"18878-2","status":"publish","type":"post","link":"https:\/\/www.berkinder.com\/en\/18878-2\/","title":{"rendered":"L\u00cdMITE AL INCREMENTO POR IPC A LOS ALQUILERES DE VIVIENDA AL 2%"},"content":{"rendered":"<p>Entre otras medidas econ\u00f3micas el art\u00edculo 46 de este Real Decreto Ley establece una limitaci\u00f3n respecto al incremento m\u00e1ximo de la actualizaci\u00f3n de las rentas de los arrendamientos de vivienda durante el periodo 31 de marzo a 30 junio 2022.<\/p>\n<p>Esta norma es de aplicaci\u00f3n:<\/p>\n<ul>\n<li>En los contratos de vivienda sujetos a la LAU de 1994.<\/li>\n<li>Y que la renta tenga que ser actualizada dentro del periodo del 31 marzo al 30 junio 2022.<\/li>\n<\/ul>\n<p>Condiciones obligatorias seg\u00fan el art\u00edculo 46 del Real Decreto Ley:<\/p>\n<p>Distingue entre cuando el propietario\/arrendador es GRAN TENEDOR (PERSONA F\u00cdSICA o JUR\u00cdDICA titular de m\u00e1s de 10 inmuebles urbanos de uso residencial o una superficie construida de m\u00e1s de 1.500 m\u00b2 de uso residencial, excluidos garajes y trasteros) y cuando el propietario\/arrendador NO ES GRAN TENEDOR (el resto).<\/p>\n<ol>\n<li>GRAN TENEDOR<\/li>\n<\/ol>\n<p>&#8211; Incremento de la actualizaci\u00f3n:<\/p>\n<ul>\n<li>El que pacten las partes, pero NO PUEDE SUPERAR EL 2%<\/li>\n<\/ul>\n<p>L\u00cdMITE: Resultado de aplicar el IGC (\u00cdndice General de Competitividad a fecha de la actualizaci\u00f3n, tomando como mes de referencia el \u00faltimo \u00edndice publicado).<\/p>\n<p>Las partes podr\u00e1n pactar una actualizaci\u00f3n inferior al 2%, pero no superior al 2%.<\/p>\n<p>(El IGC, mientras se considere que el objetivo medio de la inflaci\u00f3n en la zona euro es del 2%, solo se puede utilizar entre 0 y 2%, no por debajo ni por arriba.)<\/p>\n<ul>\n<li>Si no se pacta nada se aplicar\u00e1 el 2%<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>RESTO DE PROPIETARIOS (NO GRANDES TENEDORES):<\/li>\n<\/ol>\n<p>&#8211; Incremento de la actualizaci\u00f3n:<\/p>\n<ul>\n<li>El que pacten las partes: Las partes podr\u00e1n pactar la actualizaci\u00f3n en base al IPC publicado, sin el l\u00edmite m\u00e1ximo del 2%.<\/li>\n<li>Si no hay pacto: Se aplicar\u00e1 el 2% como m\u00e1ximo.<\/li>\n<\/ul>\n<p>&#8211; Efectos de la norma:<\/p>\n<p>No tiene efectos retroactivos.<\/p>\n<p>Solo es de aplicaci\u00f3n por las rentas que se tengan que actualizar durante el periodo entre 31 de marzo y 30 de junio 2022.<\/p>\n<p><a href=\"https:\/\/www.relaciona-t.net\/admin\/link.php?M=5596275&amp;N=12449&amp;L=16061&amp;F=H\">Art\u00edculo 46 del Real Decreto Ley 6\/2022 de 22 de marzo 2022<\/a><br \/>\n<a href=\"https:\/\/www.relaciona-t.net\/admin\/link.php?M=5596275&amp;N=12449&amp;L=16062&amp;F=H\">BOE de 30 de marzo de 2022<\/a><\/p>\n<p><strong>En BERKINDER ofrecemos asesoramiento legal, servicios de intermediaci\u00f3n en la compra y venta de inmuebles, estudios de mercado y la experiencia de m\u00e1s de 40 a\u00f1os invirtiendo y asesorando a inversores en Barcelona.
