{"id":19421,"date":"2021-02-10T18:15:36","date_gmt":"2021-02-10T18:15:36","guid":{"rendered":"https:\/\/www.berkinder.com\/aclaraciones-sentencia-tribunal-constitucional\/"},"modified":"2024-07-09T14:14:48","modified_gmt":"2024-07-09T14:14:48","slug":"aclaraciones-sentencia-tribunal-constitucional","status":"publish","type":"post","link":"https:\/\/www.berkinder.com\/en\/aclaraciones-sentencia-tribunal-constitucional\/","title":{"rendered":"Aclaraciones Sentencia Tribunal Constitucional"},"content":{"rendered":"<table width=\"90%\">\n<tbody>\n<tr>\n<td><img fetchpriority=\"high\" decoding=\"async\" class=\"size-medium wp-image-18670 aligncenter\" src=\"https:\/\/www.berkinder.com\/wp-content\/uploads\/2021\/02\/legal_law_spanish_real_estate-300x236.gif\" alt=\"lease barcelona law\" width=\"300\" height=\"236\" \/><\/p>\n<p style=\"text-align: left;\">Aclaraciones Sentencia Tribunal Constitucional contra los Decretos Ley 17\/2019 Y 1\/2020.\u00a0 La Sentencia del Tribunal Constitucional de fecha 28 de enero 2021, \u00fanicamente declara la inconstitucionalidad, es decir, la nulidad de diferentes art\u00edculos, de los siguientes Decretos Ley dictados por la Generalitat de Catalu\u00f1a:<\/p>\n<ul style=\"text-align: left;\">\n<li><strong><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2020-2509\">DECRETO LEY 17\/2019<\/a>, de 23 de diciembre, de medidas urgentes para mejorar el acceso a la vivienda.<\/strong><\/li>\n<li><strong><a href=\"https:\/\/www.boe.es\/buscar\/pdf\/2020\/BOE-A-2020-501-consolidado.pdf\">DECRETO LEY 1\/2020<\/a>, de 21 de enero, por el cual se modifica el Decreto Ley 17\/2019, de 23 de diciembre, de medidas urgentes para mejorar el acceso a la vivienda.<\/strong><\/li>\n<\/ul>\n<p style=\"text-align: left;\">Esta sentencia\u00a0<strong>NO AFECTA<\/strong> en absoluto a la <strong>Ley 11\/2020, del 18 de septiembre, de medidas urgentes en materia de CONTENCI\u00d3N DE RENTAS en los contratos de arrendamiento de vivienda.<\/strong><\/p>\n<p style=\"text-align: left;\">Consecuentemente,\u00a0<strong>sigue vigente<\/strong> la obligaci\u00f3n de determinar la renta inicial de los contratos de arrendamiento de viviendas situadas en \u00e1reas con mercado de vivienda tenso, <strong>en funci\u00f3n del \u00cdndice de Referencia de precios de alquiler<\/strong> y siguiendo la normativa establecida en esta Ley.<\/p>\n<p style=\"text-align: left;\">En relaci\u00f3n con la\u00a0<a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2020-11363#:~:text=Ley%2011%2F2020%2C%20de%2018,Ver%20texto%20consolidado\"><strong>LEY 11\/2020 sobre CONTENCI\u00d3N DE RENTAS<\/strong><\/a>, informamos de que el Tribunal Constitucional, en fecha 28 de enero 2021, admiti\u00f3 a tr\u00e1mite el <strong>Recurso de Inconstitucionalidad contra los art\u00edculos 2, 2.2, 3.3, 3.4, 6, 7.1, 15.1 16.2 y 18 y contra las Disposiciones Adicionales 1\u00aa y 4\u00aa<\/strong>\u00a0de esta norma, presentado por el PARTIDO POPULAR.<\/p>\n<p style=\"text-align: left;\">Este Recurso seguir\u00e1 su tr\u00e1mite y, en el momento en que se dicte sentencia, te informaremos puntualmente.<\/p>\n<p style=\"text-align: left;\"><strong>Mientras tanto, sigue totalmente vigente y tenemos la obligaci\u00f3n de determinar la renta de las viviendas en funci\u00f3n de su normativa.<\/strong><\/p>\n<p style=\"text-align: left;\">fuente: <a href=\"https:\/\/www.cafbl.cat\/\">cafbl.cat<\/a><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n","protected":false},"excerpt":{"rendered":"<p>Aclaraciones Sentencia Tribunal Constitucional contra los Decretos Ley 17\/2019 Y 1\/2020.\u00a0 La Sentencia del Tribunal Constitucional de fecha 28 de enero 2021, \u00fanicamente declara la inconstitucionalidad, es decir, la nulidad de diferentes art\u00edculos, de los siguientes Decretos Ley dictados por la Generalitat de Catalu\u00f1a: DECRETO LEY 17\/2019, de 23 de diciembre, de medidas urgentes para [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":19301,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[78],"tags":[79],"class_list":["post-19421","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-legal-en","tag-arrendamientos-urbanos-rentas-generalitat-en"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.2 -
